This policy describes how Get-Filly handles requests from government authorities (such as police, judicial authorities, regulators or intelligence services) for access to or disclosure of personal data of users, customers or their guests. It applies to all staff and is applied to every such request that Get-Filly receives.
Get-Filly does not disclose personal data to a government authority without first assessing the lawfulness of the request. For every request we verify:
Requests without a valid legal basis are not granted.
If Get-Filly considers a request to be unlawful, overly broad, unclear or legally unfounded, Get-Filly reserves the right to challenge or narrow the request, to ask for clarification, or to seek legal advice before any data is disclosed.
If Get-Filly is legally required to disclose data, Get-Filly limits the disclosure to the strict minimum necessary that the request requires. No additional data is disclosed beyond the scope of the lawful request.
Get-Filly documents every request received from a government authority, including:
This documentation is stored securely.
Where legally permitted, Get-Filly informs the user or customer concerned about a request relating to their personal data, unless a duty of confidentiality or a legal prohibition prevents this. Where it concerns guest data for which the customer is the controller, the customer is involved in line with the data processing agreement.
Requests from government authorities are handled solely by the founders and a designated responsible person within Get-Filly. Staff who receive such a request forward it immediately and do not disclose any data themselves.
